Potential Conflict of Interest: Third-party referrals may create potential conflicts of interest that could affect the independent exercise of legal judgment in the event of an adversarial dispute between parties.
Dual Representation of Lender: In standard residential closings, the settlement attorney also represents the mortgage lender for the limited purpose of certifying that the mortgage creates a valid, enforceable first lien on the subject property. The firm does not represent the real estate agent or broker in the transaction.
