Delaware Conveyancing & Settlement Practice

Our Legal Services & Practice Scope

In Delaware, real estate closings require direct oversight by a licensed attorney. Since June 2007, Cramer & DiMichele, P.A. has provided rigorous, attentive legal representation for buyers, sellers, refinancers, and business owners throughout New Castle, Kent, and Sussex Counties.

1. Residential Real Estate Purchases & Sales

Single-Family • Condos • Townhomes • New Construction

Whether you are purchasing your very first starter home, acquiring a beach retreat in Sussex County, or downsizing into a retirement property, our attorneys protect your interests every step of the way. We review the Agreement of Sale, conduct forensic courthouse title searches, coordinate property survey plot plans, calculate municipal tax and sewer prorations, draft the Deed and closing instruments, and conduct the closing ceremony with clear explanations of every paper you sign.

What our attorneys do for buyers:

Contract review • Legal title examination • Survey coordination • Municipal lien resolution • Preparation of Deed, Affidavits & Mortgages • Lender Closing Disclosure coordination • Recording of Deed with County Recorder

2. Mortgage Refinances (Rate-and-Term & Cash-Out)

Primary Residences • Second Homes • Investment Properties

Refinancing allows homeowners to reduce their interest rate, shorten loan terms, or leverage accumulated home equity for renovations or debt consolidation. Our office coordinates directly with your mortgage lender to examine existing land records, order mortgage payoff statements from your current lender, draft new mortgage notes and security instruments, and issue the required lender's title insurance commitment.

Prompt Refinance Closings:

We accommodate after-hours signing appointments for working professionals and ensure federal three-day right-of-rescission timelines are managed precisely so proceeds are disbursed without delay.

3. Home Equity Lines of Credit (HELOCs) & Second Mortgages

Junior Lien Financing • Subordination Agreements

When securing secondary financing, our attorneys examine prior encumbrances to ensure mortgage liens are recorded in the proper legal sequence. When required by lenders, we prepare and coordinate Subordination Agreements with existing first mortgage lienholders so junior credit lines can be funded smoothly.

4. FHA & VA Government-Backed Loan Closings

Federal Housing Administration • Veterans Affairs

Government-backed lending programs offer outstanding purchase and refinancing opportunities for Delaware families and honored military service members. These transactions involve specific federal addenda, amendatory clauses, and allowable fee limitations. Cramer & DiMichele has handled thousands of FHA and VA settlements with complete regulatory compliance.

5. Reverse Mortgages (HECM)

Senior Homeowner Equity Defense

For senior clients seeking financial flexibility in retirement, reverse mortgages provide tax-free funds based on accrued equity. Our attorneys provide patient, respectful guidance, ensuring clients and their families understand the legal mechanisms of HUD Home Equity Conversion Mortgages, repayment conditions, and deed protections.

6. Commercial Conveyancing & Business Purchases

Commercial Real Estate • Business Entity Transfers

Buying a Delaware small business or commercial property requires in-depth due diligence. Roberto DiMichele and Jaclyn Cramer represent entrepreneurs and commercial investors in business asset acquisitions, real estate purchase agreements, commercial lease assignments, UCC fixture filings, and entity resolution drafting.

Title Insurance (Lender & Owner)

While a Lender’s Policy protects only the bank's mortgage lien, an Owner’s Title Policy protects your equity for as long as you own the property for a single one-time premium. It guards against hidden defects such as fraudulent deeds, undisclosed heirs, or filing errors.
